If any condition or warranty is implied into this agreement under the Trade Practices Act 1974 (Cth) or any equivalent State or Territory legislation and cannot be excluded, and Land & Water Australia is able to limit your remedy for a breach of such a condition or warranty, then the liability of Land & Water Australia for breach of the condition or warranty is limited to one or more of the following at Land & Water Australia's option:

1. In the case of goods, the replacement of the goods or the supply of equivalent goods, the repair of the goods, the payment of the cost of replacing the goods or of acquiring equivalent goods, or the payment of the cost of having the goods repaired.
2. In the case of services, the supplying of the services again, or the payment of the cost of having the services supplied again.

The maximum aggregate liability of Land & Water Australia for all claims under or relating to these terms and conditions or their subject matter, whether in contract, tort (including without limitation negligence), in equity, under statute, under an indemnity or on any other basis, is limited to A$100.

You acknowledge that Land & Water Australia may, in its sole discretion and with or without notice:

1. vary the site or any part of the site
2. modify or discontinue this site, any part of the site and the services available on it.

These terms and conditions may be revised at any time. You accept all such revisions by accessing any part of the site after that revision is made available from the site.

This site and any right or obligation under these conditions is governed by the laws in force in the Australian Capital Territory, Australia (other than the conflict of laws rules) and the parties submit to the non-exclusive jurisdiction of the courts of the Australian Capital Territory, Australia in respect of any action that arises under the agreement.
